EzDMVThese Terms of Service ("Terms") are a legal agreement between you and EzDMV ("EzDMV," "we," "us") governing your use of the EzDMV mobile application and related services (together, the "App"). Please read these Terms and our Privacy Policy carefully — by downloading, accessing, or using the App, you agree to be bound by them. If you don't agree, please don't use the App.
1. Who can use EzDMV
If you are under 18, you may use the App only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf.
We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us at help.uptime@gmail.com and we will delete it.
2. What EzDMV is (and isn't)
EzDMV provides practice tests, study materials, and related tools to help you prepare for driver's knowledge exams.
EzDMV is an independent study aid. We are not affiliated with, endorsed by, or connected to any Department of Motor Vehicles or other government agency. Our practice questions are designed to resemble official exams, but actual exam content, format, and requirements are set by your local licensing authority and may differ. Always confirm current requirements with your local DMV.
We do not guarantee results. Using the App — including any paid features — does not guarantee that you will pass any exam. Your results depend on your own preparation and circumstances.
3. Subscriptions, purchases, and refunds
The App offers optional paid features, including subscriptions ("Premium").
Purchases are processed by the app store. All purchases made through the Apple App Store or Google Play are billed by Apple or Google under their payment terms — we never receive or store your payment card details.
Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. You can manage or cancel your subscription at any time in your device's subscription settings (App Store: Settings → [your name] → Subscriptions; Google Play: Menu → Subscriptions). Deleting the App does not cancel a subscription.
Refunds. Refunds for app store purchases are handled by Apple or Google under their respective refund policies. If you believe you were charged in error or a paid feature isn't working as described, please contact us at help.uptime@gmail.com first — we'll do our best to resolve the issue.
Pricing. We may change prices for future billing periods. If we do, the change will take effect at your next renewal, and you can cancel before then if you don't accept the new price.
4. License and acceptable use
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own, non-commercial study purposes.
You agree not to:
- copy, sell, redistribute, or publicly display App content, including practice questions and answer explanations;
- reverse-engineer, decompile, or attempt to extract the App's source code, except where the law permits it;
- use bots, scrapers, or other automated means to access the App or harvest its content;
- interfere with the App's operation or security;
- use the App for any unlawful purpose.
We may suspend or terminate access that violates this section.
5. Intellectual property
The App and all of its content — including questions, explanations, text, graphics, logos, and software — are owned by EzDMV or its licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms don't transfer any ownership rights to you.
6. Feedback
If you send us suggestions, ideas, or other feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or compensation. Please don't send feedback you consider confidential.
7. Disclaimer of warranties
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that its content reflects the current requirements of any licensing authority. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
8. Limitation of liability
To the maximum extent permitted by law, EzDMV will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of (or inability to use) the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the twelve (12) months before the claim arose, or ten U.S. dollars (US $10) if you haven't paid anything. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
9. Indemnification
You agree to indemnify and hold EzDMV harmless from claims, damages, and reasonable expenses (including attorneys' fees) arising out of your violation of these Terms or your misuse of the App.
10. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the App. Sections 5–9 and 12 survive termination. Termination does not entitle you to a refund except as required by law or the applicable app store's policies.
11. Changes to the App or these Terms
We may update the App and these Terms from time to time. Any changes will be posted on this page, and the Effective Date will be updated accordingly. Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and cancel any active subscription.
12. General
Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and EzDMV about the App. Purchases made through an app store are also subject to that store's terms.
Severability. If any provision of these Terms is found unenforceable, the rest remain in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
